All rights that are not expressly granted in this agreement are reserved for Oracle. If you wish to use the programs or your application for purposes other than those expressly defined in this Agreement, you must obtain a valid program license from Oracle or an Oracle distributor under a separate agreement to allow such use. However, they acknowledge that the programs may not be intended for production and/or that Oracle does not provide a version of the programs for production or other purposes; any development or other work you do with the programs is at risk. A decision on how and when to move into the cloud should be fairly simple. However, as with most things that concern Oracle, it`s not that simple. If your pre-calculation/order form (“Order”) is available from Oracle for NetSuite service on the day or after the 16th. The January 12, 2018 version of the data processing contract of January 12, 2018, which contains or does not explicitly exclude Oracle Cloud Services` data processing contract (“data processing contract”) available on www.oracle.com/contracts, will automatically apply to your order. “Oracle” refers to Oracle America, Inc. as “you” and “your” refers to (a) a company or organization (an entity) that accesses programs when the programs are used on behalf of that entity; or (b) anyone who accesses the programs when the programs are not used on behalf of an entity. “Cloud Service” refers to oracle Cloud, which is associated with the programs you subscribe to. “contractor” refers to your representatives and contractors (including, but not limited to outsourcing). “Programs” refers to Oracle software provided by Oracle under this Agreement, as well as all updates, error corrections and/or program documentation provided by Oracle.
